False charges for man with MS

On March 1st of 2010, I was arrested and charged with a DUI.  Without doing any research on any other “intoxicated” symptoms after an accident I was just involved in, they arrested me after doing around three hours of  tests to see if I was “intoxicated.  Master Corporal Charles S Greear badge, number 9332, did the tests at the jail house after I was arrested by Officer Christopher T, Donahue of the Idaho State, badge number 3381.  The accident happened on I-90 in Cour d’Alane, Idaho at 12:00 P.M.  My last does of medicine, (since I am on medication to treat my Multiple Sclerosis was at 10:00 A.M. These two hours were more than long enough for the medicine to wear off.  The Idaho State Police report is C10000192.  But why did the Idaho State Trooper think that I was “intoxicated?

Well, let me tell you why…..

First off, a lot of the symptoms of M.S. make a sufferer of M.S. appear like they are “intoxicated”.  And after a stressful situation, the symptoms get worse.  In a quote from About.com in an article entitledStress and MS Relapses,

While there have been few studies examining the relationship of stress and MS symptoms, MS patients often report that stress causes their symptoms to worsen. Because stress interacts with the immune system, it could be possible that stress may trigger a worsening of MS symptoms or a relapse. In a 2006, Australian researchers conducted one of the first studies to seriously examine the relationship of stress and MS relapse. This study followed 101 people with MS for 2 years and asked about their stress levels and stressful events every three months. They found that the greater number of acute stressors that a person reported predicted relapse. They also found (not surprisingly) that people who were having a relapse reported more stress. Chronic stress and stress severity did not predict relapse, only the number of acute stressors. Individuals who used social support (friends and family) to cope with stressors reduced their risk of a relapse.”

This took me ten minutes to look up and find the TRUTH.  Instead of spending three hours of the taxpayer’s time, the police could be looking for the real reason I was appearing “drunk”.  But fuck that, they would rather waste their time and taxpayer’s hard earned money.

Let me just list off only a few symptoms of M.S…….

The most common early symptoms of MS include:

Tingling

Numbness

Loss of balance

Weakness in one or more limbs

Blurred or double vision

Less common symptoms of MS may include:

Slurred speech

Sudden onset of paralysis

Fatigue. This is a characteristic and common symptom of MS. It is typically present in the midafternoon and may consist of increased muscle weakness, mental fatigue, sleepiness, or drowsiness. Dizziness. Many people with MS complain of feeling “off balance” or lightheaded. Occasionally they may experience the feeling that they or their surroundings are spinning; this is called vertigo. These symptoms are caused by damage in the complex nerve pathways that coordinate vision and other inputs into the brain that are needed to maintain balance.

Difficulty walking. Gait disturbances are amongst the most common symptoms of MS. Mostly this problem is related to muscle weakness and/or spasticity, but having balance problems or numbness in your feet can also make walking difficult.

Hello ignorant police, this took less than twenty minutes of looking stuff up online, while the police took three hours of doing BULLSHIT tests that they would use on a drunken person.

As for the medicines I am on, that are needed for my condition so I can make a living in this world, here are the FACTS on them….

Hydrocodone/Pseudoephedrine

Lamictal

Lamictal is an anti-epileptic medication, also called an anticonvulsant.

Wellbutrin is an antidepressant medication. It works in the brain to treat depression.

As with any medicine, there are possible side effects with Wellbutrin® (bupropion hydrochloride). However, not everyone who takes Wellbutrin will experience side effects. In fact, most people tolerate the medication well. When Wellbutrin side effects do occur, in most cases they are minor and either require no treatment or can easily be treated by you or your healthcare provider.

Actually it does cause a slight boost in energy, but not like caffeine affects you. It works with dopamine unlike SSRI’s which work with serotonin. You will find it useful if taken in the mornings. The drug takes at least 2 weeks to work well.

As for all of these medicines, they DO NOT say that the side affects WII HAPPEN to everyone one, but MAY happen to some.

In what could have taken less than half an hour of TRUTH seeking, the police took THREE hours of testing to say I was “intoxicated by Wellbutrin.  Which there first stop in the testing was in a gas station parking lot away from the incident for ”safety”.  So what, the police can sit in there car at the side of the road to give tickets, but wont do sobriety tests?  The police and government would rather give out speeding tickets than go after real criminals, i.e. spousal abusers.  This is all nauseating.

As for the end of the court case, they dropped the DUI.

But there violations of my rights continued.  The Idaho DOT suspended my license for having my necessary meds in my urine.  I did not even have the trial yet before they did this.  They would not even drop the suspension after the DUI got dropped and made me pay $245 to get my license back.  Since when did the constitution change to Guilty even when proven innocent in a court of law?  This was a violation of constitutional rights.

The bottom line is I got a DUI for having Multiple Sclerosis!!!

UPDATE

As you recall I was originally charged and arrested for a DUI, which the court dropped to an inattentive driving ticket for an accident on January 23rd (I got the date wrong on the first part of the article and said it was March 1st.  I apologize for the mix up.)  And even with the drop of the DUI, the Idaho DOT still charged me a reinstatement fee and did not lift the suspension until the 90 day sentence of the suspension was over.

In the end with the sentencing finally completed from the true court after the trial, I was served with a $200 dollar fine.  They did, however, waive any community service because of my condition of the MS. Now along with the $200 fine, the court charged me with $100 to pay for lab fees for medicines they already knew I was on.  Judge Watson, along with the four prosecutors assigned to case C10000192, did not reimburse mew with the $100 bail which I paid and should have been reimbursed for.

Was this all justified, or just another injustice to waste taxpayers, as well as my money?   I am letting that to the reader of this article to decide.  I do know this; I am broke and am going to have to scrape the money from thin air to pay for these fines, but oh well, right?

    Thanks Joe… for bringing this important story to the public square. There is no reason you should have been put through this kind of torment. I would advise you if you haven’t already to present your case to the American Disabilities Association. They have many lawyers who work for free to protect the rights of people with MS.
